In this study, we present data on graduate students' actual experiences in dealing with impaired peers and faculty predictions of how students would deal with such situations. A total of 29 faculty and 73 graduate students responded to a survey of 40 randomly selected clinical psychology training programs. Student respondents were almost universally (95%) aware of peers whom they regarded as impaired in their professional functioning, and half (49%) the sample reported being aware of a peer's ethical impropriety. Faculty overestimated (...) the number of students who said they "did nothing" when confronted with the resulting ethical dilemma and underestimated the degree of conflict and turmoil (i.e., anger, frustration, dismay) that students reported experiencing. Faculty also estimated that students would be more concerned with peer loyalty issues, whereas students indicated that they were strongly motivated by ethical considerations. Ethics curricula ought more thoroughly to address affective concerns through experiential learning vehicles such as faculty modeling, simulation exercises, and small-group discussion. (shrink)

It is not uncommon to hear that poor school performance, welfare dependancy, youth unemployment, and criminal activity result more from shortcomings in the personal makeup of individuals than from societal forces beyond their control. Apocalypse, Girard reminds us, "means revelation: apocalypto means to open up and to show the truth. But it also means absolute violence, so the apocalypse is a violent revelation and a revelation of violence" (Girard 1996). That the Revelation is a violent revelation has been well established. Despite textual evidence that would beg those who approach the text to do just the opposite, readers have fixated on the violence of the Revelation since its inception, finding in it God's final retribution against those who persecute the Church.1 Commentators such as Dennis E. Johnson, William Hendricksen, and George Elden Ladd have produced recent, full-length commentaries that champion the appearance of a Christ in Revelation ready to establish himself as a military champion and exact his revenge on those who persecute him (see, for example, Johnson 2001; Hendricksen 1998; and Ladd 1993). These accounts, and those that follow suit, are blinded by the violent revelation of John's apocalyptic narrative and fail to see the poem's revelation of violence—the other, prophetic half of what Girard rightly contends exists in Christian apocalypse.This error is understandable to some extent. Read in its own light and apart from the Gospel revelation as understood by those familiar with mimetic [End Page 99] theory, one has no hermeneutical principle for recognizing the end to which John is writing. The victims of the text can be ignored in the precise way that all victims are disregarded when the scapegoat mechanism functions properly. Such should not be the case in the Revelation, though, a text in which the scapegoat mechanism is exposed and pushed to its logical conclusions. John offers his reader a glimpse into the way this mechanism will function when all that is left is wall-to-wall violence, when one is left with only two alternatives: succumb to the mechanism and reciprocate its violence, or extricate oneself through nonreciprocation (and potentially die).In the margins of the violent revelation in John's apocalyptic vision, a revelation of violence emerges that can expose humankind's potential to annihilate itself and the mechanism with which it will do so. When read through the lens of mimetic theory, one discovers that John's narrative delivers a revelation of violence, an explicit naming and unmasking of the sacrificial mechanism that can capture for the reader not only the machinations of the sacrificial apparatus but one's own potential participation in it as well. As such, the poem can posit itself as a commandment (a Thou-shall-not-murder) that ultimately refuses the temptation to respond to violence in violence.The fact that John uses the apocalyptic to present this directive should not be surprising. Girard writes: "Only through the mediation of the scapegoat mechanism can violence become its own remedy, and the victimage mechanism can only be triggered by the frenetic paroxysm of the 'crisis.' This means that the violence, having lost its vitality and bite, will paradoxically be more terrible than before its decline. As the whole of humanity makes the vain effort to reinstate its reconciliatory and sacrificial virtues, this violence will without doubt tend to multiply its victims, just as happened in the time of the prophets" (Girard 1978, 195–96). _John Dewey and Continental Philosophy_ provides a rich sampling of exchanges that could have taken place long ago between the traditions of American pragmatism and continental philosophy had the lines of communication been more open between Dewey and his European contemporaries. Since they were not, Paul Fairfield and thirteen of his colleagues seek to remedy the situation by bringing the philosophy of Dewey into conversation with several currents in continental philosophical thought, from post-Kantian idealism and the work of Friedrich Nietzsche (...) to twentieth-century phenomenology, hermeneutics, and poststructuralism. This unique volume includes discussions comparing and contrasting Dewey with the German philosophers G. W. F. Hegel, Friedrich Nietzsche, Martin Heidegger, and Hans-Georg Gadamer on such topics as phenomenology, naturalism, organicism, contextualism, and poetry. J. G. Fichte’s »Tagebuch über den [animalischen] Magnetismus« [»Diary of the [animal] Magnetism«] from 1813 consists largely of excerpts and comments on reports from patients who have been treated with applications of animal magnetism. As part of the preparations for the critical edition of Fichte’s „Tagebuch über den Magnetismus“ the central text on which Fichte founded his further philosophical considerations could be identified: It is Franz Anton Mesmer’s „Allgemeine Erläuterungen über den Magnetismus und den Somnambulismus. Als vorläufige Einleitung in das (...) Natursystem.“ [„General Explanations about magnetism and somnambulism. As a preliminary introduction to the system of nature.”] of 1812. The following article shows how Fichte came into touch with the subject of animal magnetism and how he specifically dealt with Mesmer’s text. Mesmer’s concern to develop a unified conception of nature that brings all the laws of nature into a closed system matches with Fichte’s intention to form a systematic unity of all knowledge. However, Fichte discovered in Mesmer’s project several problematic concepts such as the constitution of the organism and of man as a spiritual being, which Fichte criticizes and makes the starting point for his own ideas. His idea of a liberal-idealistic and thus dynamic system of nature always remains present.J. G. The realities and myths of long-term care and the challenges it poses for the ethics of autonomy are analyzed in this perceptive work. The book defends the concept of autonomy, but argues that the standard view of autonomy as non-interference and independence has only a limited applicability for long term care. The treatment of actual autonomy stresses the developmental and social nature of human persons and the priority of identification over autonomous choice. The work balances analysis of the ethical concepts (...) associated with autonomy with discussion of the implications of the ethical analysis for long term care. A central chapter involves a phenomenological analysis of four general features of everyday experience (space, time, communication, and affectivity) and explores their practical implications for long term care. But the study of detection need not be restricted to the generic as familiarly construed. 1 Our interest in detection is transgeneric, which is why we speak in terms of “detection narratives” rather than the detective (...) genre. We are as interested in detection narratives that exploit the generic tendencies of suspense or comedy as we are in nongeneric narratives that feature an investigation of some mystery or crime. While what we have to say about detection, interpretation, and narrative explanation is generally applicable to both literary and non-literary detection narratives, our five main examples are all unapologetically taken from cinema. We have selected these five just because they are unlikely to strike anyone as an intuitively obvious group of films. They are The Thin Man (W. S. Van Dyke, 1934), a mystery/comedy; The Maltese Falcon (John Huston, 1941), standardly cited as the earliest film noir and a paradigm of the cinematic hard-boiled detective genre; All The President’s Men (Alan J. Pakula, 1976), a political thriller based on Bernstein and Woodward’s nonfictional investigation of the Watergate break-in; Nicholas Roeg’s 1980 Bad Timing, a nongeneric film about sensual obsession; and Woody Allen’s 1993 comedy of manners, Manhattan Murder Mystery.Whether focusing on the investigation of a crime, the unraveling of a puzzle, or the solution of a mystery, detection narratives exhibit what Frank Kermode calls “a specialized ‘hermeneutic’ organization.” 2 As such, they call for a particular sort of investigation: namely, a hermeneutical one. Often we think about hermeneutical investigations as [End Page 123] interpretations and assume that the proper object of such interpretations is a text. Thinking primarily about literary texts, David Novitz argues that the function of such explanations is to “solve certain puzzles, answer certain questions, dispel confusions, or eliminate doubts about... the theme of a work or its plot, [or] about the actions, motives, or machinations of fictional characters....” 3Of course, interpretation is not restricted to literary texts, nor to answering specific questions about such matters as theme or plot or character motivation, nor does Novitz suggest it is. But when the object of interpretation is a text—literary, cinematic, legal, or other—it is arguable that interpretation is not restricted to those localized aspects of the text which we take to be puzzling. Novitz’s position is that interpretation only occurs when one confronts a specific puzzle or problem. What we understand directly is not, on this account, interpreted; interpretation is required only where we do not understand. The consideration of detection narratives suggests that understanding and interpretation are more closely related than Novitz seems to allow.In our attempts to make sense of the course of action of any detection narrative, there is always the question whether we have understood a given situation, event, action or statement correctly. It is always a question whether we have correctly distinguished between clues and red herrings. Detection narratives operate on the basis of a continual questioning—both for the detective and for the reader or viewer—as to whether we do, in fact, understand what is happening.This questioning attitude is keyed to the uncertainty as to whether we have correctly recognized what information is salient, which characters’ testimony is trustworthy. At various moments in any detection narrative, the detective (or reader/viewer) will have reason to question the reliability of their own assessment of what is going on. There is the risk of being mistaken, but also the risk of being deceived. So the appropriate attitude to detection narratives is an interpretive one, an attitude that asks questions about what is presented.Of course, particular questions cannot even be sensibly asked in the absence of a larger interpretive framework which gives the particular question its point. How closely involved with hospital ethics committees should patients and their families become? Should they routinely have access to committees, or be empowered to initiate consultations? To what extent should they be informed of the content or outcome of committee deliberations? Seeing ethics committees as the locus of competing responsibilities allows us to respond to the questions posed by a patient rights model and to acknowledge more fully the complex moral dynamics of clinical medicine.

Alberto Coffa ON SEVERAL OCCASIONS Russell pointed out that the discovery of his celebrated paradox concerning the class of all classes not belonging to themselves was intimately related to Cantor's proof that there is no greatest cardinal. lOne of the earliest remarks to that effect occurs in The Principles ofMathematics where, referring to the universal class, the class of all classes (...) and the class of all propositions, he notes that when we apply the reasoning of his [Cantor's] proofto the cases in question we find ourselves met by definite contradictions, of which the one discussed in Chapter x is an example. (P. 362) And in a footnote he adds: "It was in this way that I discovered this contradiction". Throughout his writings Russell left a number ofhints concerning the sort of connection he had drawn between Cantor's proof and his own discovery. Cantor has a proof that there is no greatest number, and if this proof were valid, the contradictions of infinity would reappear in a sublimated form. So, it is not surprising, though still (...) ironic, that ethics consultation, which develops from this patient rights-dominated ethic, should itself bring forth questions of authority. Nonetheless, it does. Insofar as authority has been discussed in ethics consultations, it has been understandably approached from the broad perspective of legitimation and power, which are common themes in social and political treatments of authority. These treatments have dominated twentieth-century discussions of authority, which primarily view authority as legitimate power. (shrink)

Recent philosophical attention to the language of disease has focused primarily on the question of its value-neutrality or non-neutrality. Proponents of the value-neutrality thesis symbolically combine political and other criticisms of medicine in an attack on what they see as value-infected uses of disease language. The present essay argues against two theses associated with this view: a methodological thesis which tends to divorce the analysis of disease language from the context of the practice of medicine and a substantive thesis which (...) holds that disease language is evaluatively neutral. In particular, the essay critically focuses on the value neutral position adopted by Christopher Boorse, which he terms a functional theory of disease. While there is no denying the relevance of ethical knowledge and analytical and cognitive skills in ethics consultation, such knowledge and skills can be overemphasized. They can be effectively put into practice only by an ethics consultant, who has a broad range of other skills, including interpretive and communicative capacities as well as the capacity effectively to address the psychosocial needs of patients, family members, and healthcare professionals in the context of an ethics consultation case. In this paper, I discuss (...) how emotion can play an important interpretive role in clinical ethics consultation and why attention to the role of defense mechanisms can be helpful. I concentrate on defense mechanisms, arguing first, that the presence of these mechanisms is understandable given the emotional stresses and communicative occlusions that occur between the families of patients and critical care professionals in the circumstances of critical care; second, that identifying these mechanisms is essential for interpreting and managing how these factors influence the way that the “facts” of the case are understood by family members; and, third, that effectively addressing these mechanisms is an important component for effectively doing ethics consultation. Recognizing defense mechanisms, understanding how and why they operate, and knowing how to deal with these defense mechanisms when they pose problems for communication or decision making are thus essential prerequisites for effective ethics consultation, especially in critical care. Frank Koughan and Walt Bogdanich's response to my article, reminds me of the Shakespearean line, My article was not about the specifics of the 60Minutes April 13, 1997, story on NHBD at the Cleveland Clinic Foundation (CCF), even though the story formed the basis for the reflection. I did not attack the critics, though I do believe that bioethicists are accountable for their scholarly and public pronouncements. Although I do not see why the 60Minutes' story should be treated with deference, (...) my article was designed to raise questions for a primarily bioethics audience about the involvement of bioethicists in media coverage of bioethics topics. I am flattered that they took notice of my piece, but think their efforts to set the record straight only obfuscate matters further. (shrink)

The proliferation of ethics committees and ethics consultation services has engendered a discussion of the issue of the expertise of those who provide clinical ethics consultation services. In this paper, I discuss two aspects of this issue: the cognitive dimension or content knowledge that the clinical ethics consultant should possess and the practical dimension or set of dispositions, skills, and traits that are necessary for effective ethics consultation. I argue that the failure to differentiate and fully explicate these dimensions contributes (...) to the confusion over the issue of expertise and fuels, at least partly, the controversies about expertise (or authority) in ethics and the legitimacy of the use of ethical knowledge in clinical ethics consultation. This article accepts the proposition that old people want to be treated with dignity and that statements about dignity point to ethical duties that, if not independent of rights, at least enhance rights in ethically important ways. In contexts of policy and law, dignity can certainly have a substantive as well as rhetorical function. However, the article questions whether the concept of dignity can provide practical guidance for choosing among alternative approaches to the care of old people. The article explores (...) the paradoxical relationship between the apparent lack of specific content in many conceptions of dignity and the broad utility that dignity appears to have as a concept expressive of shared social understandings about the status of old people.
